Reporting to the Chief Executive Officer, the Head of Legal is responsible for working with numerous members of the management team including in the key areas below to provide legal input and advice into the decision making process of the Company and to ensure that the Company's legal interests are properly managed to realise business objectives within a safe, compliant and cost effective framework.
Responsible for the management of the internal legal service provision and where appropriate the instruction of external legal advice in agreement with the Finance Director where required.
Role & Responsibilities:
Corporate legal matters
• To review/advise on all general legal corporate matters/correspondence.
• To maintain a legal register of all legal issues and to manage external legal advisers when used. The individual will take the lead in ensuring the Company achieves competitive fees when external legal advisers are used.
• To manage the Company's trademarks in conjunction with the external trademark attorneys.

• To carry out risk assessments on all contracts prior to tender submission and/or signature. To advise the Company Directors of any associated risk in relation to signing the contract - and where it occurs to negotiate with the commissioner to amend and minimise the impact of such risk where possible.
• To advise and work with HR in the instance of TUPE transfers, so as to ensure all considerations are taken into account and business risk is minimised.
• To review and amend our standard terms of business as required.
• To prepare and review contract documentation in relation to commissioning third party suppliers.

Human Resources:
• To provide advice and support where required.

• To provide legal advice and reviewing the Company's policies and processes from a legal perspective.
• Providing legal advice in relation to our regulatory and statutory requirements including CQC and DBS requirements.
• Providing legal advice in relation to complaints or investigations involving the Company.

Data Protection and Freedom of Information Act:
• To provide advice and respond to requests from external parties.
• Responsible for managing the Data Protection Renewals.

Litigation and Insurance:
• Responsible for dealing with litigated claims against the Company or where appropriate liaising with external legal advisors.
• Responsible for maintaining a register of litigated claims against the Company.
• Responsible for liaising with Insurers and loss adjusters as required.
